Terms of Service

These terms are the agreement between you and Earno for using the app. We have tried to write them in words that mean something, and to say the awkward parts out loud rather than bury them.

1. About these terms

Earno is operated by Bouteraa Devops Solutions, a sole proprietorship (Jednoosobowa Działalność Gospodarcza) established in Poland (VAT PL6751526881, REGON 544530975), Warsaw, Poland ("Earno", "we", "us"). By downloading or using Earno, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the app.

You can read both documents at any time in Profile, under Privacy and data, and at earno-app.com.

If you installed Earno from the App Store, Apple's Standard End User Licence Agreement also applies to your copy of the app, and where these terms and that agreement disagree about the app licence itself, that agreement wins. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula. Section 17 below sets out the terms that apply because you got Earno from Apple.

2. Who can use Earno

You must be at least 13 years old to use Earno. By using it, you confirm that you are, and that what you tell us is accurate. If you are under 18, please make sure a parent or guardian is happy for you to use Earno.

Some optional features have a higher age: community spotlights are only offered from 16.

3. Your account

You can use Earno without an account. An account, which uses your email address, lets you restore your data on a new device, take part in challenges with friends, and hold a Pro subscription.

Keep your email and your device secure, and tell us if you think someone else is using your account. You are responsible for what happens under your account.

4. What Earno is, and is not

Earno is a motivation and habit tool. It helps you resist spending and keep track of what you chose to save. The amounts you see are your own estimates of money you did not spend.

Earno is not a bank, a wallet, a payment or money-transfer service, and it is not financial, investment, tax, medical or therapeutic advice. We never hold, move or have access to your actual money. Real savings only happen in your own bank account, through your own choices.

If you are using Earno to help you stop something that affects your health, it is a motivational tool and nothing more. Please talk to a doctor or a qualified service for anything medical.

5. Your licence to use Earno

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Earno for your own personal, non-commercial use, in line with these terms and with the rules of the store you installed it from.

The licence covers the devices you own or control, and a Pro subscription follows you to each of them when you sign in with the same email address.

Please use Earno fairly. You agree not to:

7. Your content and friend challenges

You keep ownership of the challenges and data you create. You are responsible for what you enter, including the names you give challenges, and for only inviting people you know, using their real email address.

You give us permission to process your content solely to provide the app to you and, for shared challenges, to the friends you invite. Section 5 of our Privacy Policy explains what a challenge name can reveal and where it travels.

8. Subscriptions and payments

Earno is free to use. The free plan gives you one active challenge, up to 30 days long. It does not include friend invites, and the Insights tab is part of Pro.

Pro is our optional paid plan. It gives you unlimited challenges with no duration limit, challenges shared with up to 4 friends, the Insights tab with its projections, and extra badges. Everything Pro includes is listed on the Pro screen in the app before you subscribe.

What you can buy. There are two subscriptions: Earno Pro Monthly, which runs for 1 month, and Earno Pro Yearly, which runs for 1 year. They give you the same Pro features, and you can hold only one of them at a time.

Who sells it. Pro is sold and billed by the store you installed Earno from: Apple, through your App Store account, or Google, through your Google Play account. In the EU and the EEA that seller is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork T23 YK84, Ireland, or Google Commerce Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Your contract for the subscription is with them, your receipt comes from them, and we never receive, see or store your card or bank details. These terms are your contract with us, and they cover the app itself.

There is no other way to buy Pro. We do not sell it on our website, we never take payment directly, and we do not offer a different price anywhere else.

Before you buy. Pro needs an Earno account, which means an email address you have confirmed. This is not a hurdle for its own sake: Pro is held on your account rather than on one phone, so that it survives a lost or replaced device, works everywhere you sign in, and can be found for you if something goes wrong.

What you are told before you buy. On the Pro screen, before you confirm anything, you see the name of the subscription, how long each period lasts, and the price for that period in your own currency as your store reports it. Our reference prices are 4.99 US dollars a month and 39.99 US dollars a year; your store sets the matching price for your country, so the number you pay may differ, and the price on the Pro screen is always the one your store will charge. Your store handles any tax and shows you the final amount before you confirm.

What Pro needs in order to run. Earno runs on the iPhone and Android versions listed on your store's page for the app. Checking in and reading your history work offline. A backup, a shared challenge, a purchase and a restore each need an internet connection.

When you are charged. Payment is charged to your store account when you confirm the purchase.

Automatic renewal. Your store renews the subscription automatically at the end of every period unless auto renew is turned off at least 24 hours before that period ends. Your store account is charged for the next period within the 24 hours before the current one ends, at the price then in force for your plan. This continues until you cancel. Those are your store's rules, and it is your store that applies them.

How long you are tied in. The shortest you can commit to is the period you buy, which is one month or one year. There is no minimum term beyond that, no notice period, and no fee for cancelling.

How to cancel. Cancel at least 24 hours before the current period ends, otherwise the next period is charged. You cancel in your store account settings, in App Store subscriptions or Google Play subscriptions, and you can open those settings from the Pro screen in Earno. We cannot cancel a store subscription for you. Cancelling does not refund the period you are already in: you keep Pro until it ends, and nothing is charged after that.

Deleting the Earno app does not cancel a subscription, and neither does deleting your Earno account. Cancel in your store account first.

If a payment fails. Your store will retry for a while, and during that time you normally keep Pro. If it still cannot take payment, your store suspends or ends the subscription and Earno returns to the free plan. Updating your payment method with your store is what puts it right.

Free trials. Where we offer one, the free trial runs for 7 days on the yearly plan, one per store account, and it is set up and run by your store. How long it lasts and what it becomes are shown before it starts. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription and your store account is charged at the price shown. If you buy a subscription while a trial is running, any unused part of that trial is forfeited. Cancelling a trial happens in your store account, in the same place as any other subscription.

If you are under 18, ask a parent or guardian before you subscribe. On the App Store and on Google Play they can also switch on Ask to Buy, which means a purchase waits for their approval before anything is charged.

Restoring a purchase. If you reinstall Earno or move to a new phone, tap Restore purchases on the Pro screen and your store returns your subscription to you. You do not need an Earno account to restore: Restore purchases brings the subscription back on that device on its own, and signing in with your email is what makes it follow you to the next phone. Restore while signed in to the same store account that bought it.

On your devices. One subscription covers you on every device where you sign in to Earno with the same email address, on iPhone and on Android. Pro is not shared through Family Sharing, so each person who wants Pro subscribes for themselves.

Switching between monthly and yearly. You can change plan on the Pro screen. Your store handles the change, and it tells you what it will charge and when the new plan starts before you confirm.

If Pro does not work as described. Pro has to match what we describe here and on the Pro screen, and it has to keep matching for as long as you are subscribed. If it does not, write to support@earno-app.com and we will put it right at no cost to you. If we cannot, or we do not do it within a reasonable time, you can ask for a reduction for the affected period, or end the subscription and ask for money back for what you did not get. These rights are yours by law and nothing here takes them away.

When a subscription ends. You keep Pro until the end of the period you have already paid for. After that Earno returns to the free plan.

Nothing you recorded is deleted, and everything you have earned stays in your history. But the free plan does not include challenges shared with friends, and it caps a challenge at 30 days, so when Pro ends anything outside those limits is closed and moved to your Past. A challenge you host with friends is closed for everyone in it, and they are told it ended. You leave any shared challenge you had joined, and its host is told. This is worth knowing before you cancel in the middle of one.

Subscribing again lifts the limits for what you start next, but a challenge that was already closed stays in your Past rather than reopening.

You can always get out what you put in. Download my data stays available on the free plan, and if you want the copy we hold on our servers as well, ask us at privacy@earno-app.com and we will send it to you free of charge.

Refunds. A refund of money already charged comes from your store, because your store took the payment and applies its own rules. On the App Store, use Report a Problem in your purchase history, and Apple decides it. On Google Play, ask Google within 48 hours of the charge and Google decides it; after 48 hours Google sends you to us, so write to support@earno-app.com and we will answer within 5 working days and refund where the law where you live gives you the right, or where the reason deserves one. If a refund is given, the subscription ends and Earno returns to the free plan as described above.

Price changes. We may change the price of a future period, for example because our costs change or a store changes its fees or the tax in your country. You will always be told before a new price applies to you, and depending on the size of the change your store will either ask you to agree or give you the chance to cancel first. A price change never affects a period you have already paid for.

One subscription at a time. Pro belongs to the Earno account you are signed in to. If you have paid twice by mistake, tell us at support@earno-app.com and we will help you get the second one refunded by your store.

EU right of withdrawal. If you live in the EU or the EEA you have 14 days to change your mind about a purchase, without giving a reason. Your store is the seller, so that right is exercised through your store, under the terms it shows you when you confirm, including anything it asks you to acknowledge about starting straight away. Nothing in these terms affects your statutory consumer rights, and if you are stuck, write to us and we will help you reach the right place.

Complimentary access. We can switch Pro on for an account from our own side, for example for a tester or while we are sorting out a problem. It is never sold, there is no code to redeem and no way to buy it this way, nothing is billed, nothing renews, there is no store subscription to cancel, and we may end it with reasonable notice.

One thing that is never paid for. Download my data, in Profile under Privacy and data, and deleting your account are on every plan including the free one, because they are your rights and not features.

9. Intellectual property

Earno, including its name, its design, Lumen the mascot, and its software, belongs to us and our licensors. These terms do not give you any rights in them beyond the licence above.

10. Availability, updates and changes

We will keep giving you the updates, including security updates, that Earno needs in order to go on working the way we describe it. For Pro that lasts for as long as you are subscribed. For the free app it lasts for as long as you can reasonably expect, given the kind of app it is.

We may change Earno, and these are the only reasons we will use: to keep it secure, to fix or improve how it works, to add a feature or retire one that few people use, to keep up with a change in the law, or because a service we rely on changes. If a change would make Pro clearly worse for you, we will tell you at least 30 days beforehand, in the app or by email, and you can cancel free of charge before it takes effect.

We may update these terms, and only for a good reason: a change in the law, a change to how Earno works, a new feature, or a change at a service we rely on. When we do, we change the effective date and tell you in the app before it takes effect. If an important change is not something you want, you can stop using Earno and cancel any subscription.

11. What we promise, and what we do not

We promise that Earno works the way we describe it, and that Pro keeps working that way for as long as you are subscribed. If it does not, section 8 sets out what you can ask us for, and those rights are yours by law.

What we do not promise is any particular financial result or amount of savings. What you achieve depends on your own choices, and the amounts in Earno are your own estimates. Beyond that, Earno is provided as it is and as available.

12. Our liability

We are responsible for the harm we cause, and we do not try to sign that away. What we do not take on is loss we could not reasonably have seen coming, and loss that comes from treating Earno's estimates as financial advice, because Earno is a motivation tool and the numbers in it are your own.

Nothing here excludes or limits our liability where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, or for your mandatory consumer rights.

13. Ending your use

You can stop using Earno, delete your data, or delete your account at any time, from Profile under Privacy and data. Deleting your account removes your data as described in our Privacy Policy. It does not cancel a subscription, which you cancel in your store account.

We may suspend or end your access if you seriously or repeatedly break these terms or the Community Guidelines, or where we must for legal or security reasons.

We also remove accounts that stay completely inactive for a long period, after 90 days without an email address or 365 days with one, together with their server-side data. Any use of Earno resets this, and paid or trial accounts are never removed this way.

14. Community spotlights

We may invite you to be featured for a standout challenge. We ask inside the app first, and we only use your first name, your country and what you achieved if you tick to approve it. For a shared challenge, every member must approve. Taking part is optional, it is offered only from age 16, and you can withdraw at any time. See our Privacy Policy for how this works.

15. Governing law and disputes

These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your own country's courts.

Please contact us first at support@earno-app.com so we can try to sort things out directly. We are not signed up to any particular out-of-court dispute resolution body, and we are not required to be. If you are a consumer in the EU you can ask the European Consumer Centre in your country for free help, and your national consumer authority can tell you whether an out-of-court scheme covers this kind of dispute.

16. If you bought a subscription

Your subscription is a contract with the store that sold it, as section 8 explains. If you are unsure whether something is ours to fix or your store's, ask us at support@earno-app.com and we will tell you, and help you get to the right place.

17. If you installed Earno from the App Store

These terms are between you and us only. Apple is not a party to them, and Apple is not responsible for Earno or its contents.

Apple has no obligation to provide any maintenance or support for Earno. If you need help, come to us at support@earno-app.com.

Your licence to use Earno is a licence to run it on the Apple-branded products you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.

If Earno fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all in relation to Earno, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.

We, not Apple, are responsible for addressing any claim you or anyone else makes about Earno or your use of it, including product liability claims, any claim that Earno fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law. We are also responsible for investigating, defending, settling and discharging any third-party claim that Earno infringes that party's intellectual property rights.

You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a terrorist supporting country, and that you are not on any US Government list of prohibited or restricted parties.

You must comply with any applicable third-party terms when using Earno.

Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and on your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
